These Terms & Conditions (“Terms”) govern your use of the services provided by Lofty Furnishing (“we,” “us,” “our”) via https://loftyfurnishing.com (the “Site”). By booking a service or using our Site, you agree to these Terms in full. If you disagree, please do not use our Site or services.
1. Services
We offer custom delivery and installation of lofted bed frames (“Services”) at Pennsylvania State University Main Campus addresses. Each Service is 1 hour long, at a flat fee you pay in advance. Details of your booking—including date, time, and delivery address—will be confirmed in writing after purchase.
2. Booking, Payment & Fees
- Booking Confirmation: As soon as your order is placed on the Site.
- Payment: Processed via WooPay. Card details are stored securely off-site by WooPay; we do not retain your full card number.
- Pricing: Full service fee due at time of booking. No partial refunds except as described below.
3. Cancellations, Rescheduling & Returns
Cancellation & Rescheduling
- Full Refund
- Cancel at least 48 hours before your scheduled install and receive 100% of your installation fee back.
- Late Cancellation Fee
- Cancel within 48 hours of your scheduled install and a $25 cancellation fee applies. The remainder of your payment will be refunded.
- How to Cancel
- To cancel, email support@loftyfurnishing.com with your order number and desired cancellation date.
- Rescheduling
- Subject to availability.
- To reschedule, email support@loftyfurnishing.com at least 48 hours before your original Booking Date & Time.
Returns & Uninstallation
Definition- Excellent condition defines that the product has no noticeable defects, full functionality, and no damages.
- Returns (Days 0–14)
- If you request a return within 14 days of installation and the bed is in “Excellent Condition,” you’ll receive a full refund minus a $50 return fee.
- We’ll un-install and pick up your bed within 7 days of processing your return.
- Returns (After 14 Days)
- Returns made after 14 days—regardless of condition—are eligible for a free uninstall, email to schedule.
4. Refund Processing
- All refunds (full or partial) are issued to the original payment method within 5–7 business days of your cancellation or return request.
- You’ll receive an email confirmation once your refund has been initiated.
5. Release of Liability & Assumption of Risk
By booking our installation service, you acknowledge and agree that:
- Assumption of Risk. You assume all risk of injury or loss arising from the installation. You agree to clear a safe, unobstructed workspace and ensure the structural integrity of your dorm room.
- Release of Liability. Except for our gross negligence or willful misconduct, you release Lofty Furnishing, its employees, agents, and contractors from any claims, liabilities, or damages—whether personal injury, property damage, or other loss—arising out of or in connection with the Services.
6. Limitation of Liability
Our maximum aggregate liability to you for any claim related to the Services or Site, whether in contract, tort, or otherwise, shall not exceed the total fees you paid for the specific installation giving rise to the claim. Under no circumstances shall we be liable for any indirect, incidental, special, or consequential damages.
7. Indemnification
You agree to defend, indemnify, and hold harmless Lofty Furnishing and its officers, directors, employees, and agents from any third-party claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your negligence in using our Services.
8. Intellectual Property
All content on the Site—text, graphics, logos, images, and software—is our property or licensed to us and is protected by U.S. and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Centre County, Pennsylvania.
10. Changes to Terms
We may modify these Terms at any time by posting the updated version on this page. The “Last updated” date will be revised. Your continued use of the Site or Services after any changes constitutes your acceptance of the new Terms.
